Service Terms and Conditions

These Terms and Conditions are intended to define the basic matters such as rights, obligations, and responsibilities of the company and users, and the conditions of service use, in relation to the Artinai service (hereinafter referred to as “Service”) provided by "Floopy (here in after “Company”)

Article 1 (Effectiveness and Amendment of Terms)

1. The Company posts these Terms on the initial screen of the Service so that users can verify them.
2. These Terms become effective upon the user's agreement and simultaneous use of the Service. If the user does not agree to these Terms, they may withdraw from the service contract.
3. The Company may change these Terms within the scope not contrary to related laws.
4. Amended Terms will be announced on the homepage from 7 days prior to the effective date until the day before the effective date, specifying the effective date, changes, and reasons for changes. However, in the case of amendments unfavorable to the users, they will be announced from 30 days prior to the effective date. The amended Terms become effective from the effective date.
5. Users have the right not to agree to the changed Terms and may discontinue the use of the Service and withdraw if they do not agree to the changed Terms.
6. If the user does not explicitly express refusal to the Company at the time of the announcement of the changed Terms or continues to use the Service after the effective date of the changed Terms, it is considered as agreement to the changed Terms.

Article 2 (Content Use and Copyright)

1. The Service produces content (such as photos) using AI technology with user-uploaded photos. The copyright of the photos posted by users or the content received after using the Service belongs to the users.

2. Intellectual property rights, including the Company’s trademarks, logos, and posts, related to the Service and advertisements created and provided by the Company, belong to the Company.

3. Users acknowledge and agree that the quality of content produced by AI can vary and may include somewhat inappropriate content.

4. Users bear full responsibility for their content and any claims arising from it, and agree that the Company has no responsibility or legal liability for any user content or claims arising from it.

5. The Company reserves the right and full discretion to review and verify user content at any time, without reason, and may delete content if it finds any violation of the Service Usage Rules (Article 3).

6. The validity period of the content provided by the Company is one year, after which the Company may destroy the content.

7. Data storage and usage by users are as follows:

   a. Storage

   • Data collected by the Service includes user photos and additional information (email, gender, age range) from each login platform. Each data is transmitted to and stored in Amazon Web Service (Korea Region).

   b. Transformation

   • The Service transforms the final product to the user through various processes based on AI. Some of these transformations are done through GPU servers at https://replicate.com/ using models owned by the Company.
